How Does the West Virginia Municipal Court Work?

West Virginia Municipal Courts are courts created by cities and municipalities following West Virginia Code §8–10–2.

West Virginia Municipal Courts generally have jurisdiction over cases that involve violations of municipal ordinances and traffic infractions. However, in areas where there are no Municipal Courts, jurisdiction over these cases falls to the Magistrate Courts. Most cases heard in these courts do not involve juries. Only individuals charged with an offense with a penalty of jail time are entitled to jury trials.

Cities and municipalities are responsible for the appointment or election of Municipal Court judges. Any individual that wishes to become a Municipal County judge will be required to submit a criminal background check conducted by the West Virginia State Police. Individuals that have been convicted of any felony and misdemeanor crimes listed in West Virginia Code Chapter 61, Articles 8—8D are ineligible to become Municipal County judges.

Municipal Court judges are not required to be lawyers. However, before an individual who has not practiced West Virginia law can become a Municipal Court judge, the individual will be required to attend and complete an introductory training course on West Virginia law and procedure principles. The training must involve the services of a licensed attorney that has practiced law in the state of West Virginia for a minimum of three years. Appointed non-lawyer Municipal Court judges will also be required to attend this training course annually.

Members of the public who wish to access Municipal Court records may do so by contacting the Municipal Court Clerk office, where the case was filed. Requestors may be required to pay a nominal fee before copies of these records can be obtained.
